「人工智慧」係指擁有類似人類智慧的電腦程式,透過電腦的發明、網際網路的盛行、人類神經細胞的分析與仿造等,人類的智慧得以在機器上重現且漸趨完整。尤其在大數據及深度學習出現後,再次將人工智慧發展推向另一波高潮,惟在新技術問世後,許多問題即陸續接踵而來。而人工智慧與其他新科技技術不同的是其擁有如同人類智慧般的思考模式,甚至連程式設計者本身皆無法完全了解其演算過程。也因為人工智慧的難預測性、不透明性等問題,對於傳統刑法體系將可能造成衝擊,例如人工智慧是否具有法律人格的問題,以及發生損害結果時應如何劃分責任歸屬的爭議。 本文主要透過文獻分析、比較研究及綜合歸納的方法進行研究。首先針對人工智慧是否

具有法律人格的問題進行釐清,本文認為基於人工智慧技術目前的發展狀況,應採取否定說,唯有未來真出現完全不受人類程式編列限制、可依自主意識行為的強人工智慧時,才應例外採取區分說。 接著本文將分別介紹人工智慧的三大應用領域-自動駕駛、司法系統及醫療系統。除了介紹人工智慧在各領域應用的基礎外,也將分別提出人工智慧將帶來的影響,以及發生刑法爭議時責任歸屬的劃分。尤其是當人類與人工智慧共同造成損害結果時,刑事責任應如何歸責即成為重點。本文將分析現有的學說文獻及相關見解,並提出個人見解,希望可藉此提供解決之道。而目前人工智慧仍處於剛開始發展的狀態,為了促進人工智慧的發展,政府應建立良好的實驗場域供民間

投入研究。此外,目前我國關於人工智慧法律規範尚未完備,若未來發生有關人工智慧的法律爭議,將可能會是相當棘手的問題,因此促進相關法規的訂定係為我國應持續努力的目標。

漁船跨境毒品販運防制之研究 —以環境犯罪學觀點為基礎

我國毒品查緝量快速上升,然而毒品均自境外藉由海運、空運途徑走私入境,而走私犯罪者利用漁船做為跨境運輸毒品犯罪工具的案件層出不斷,犯罪者充足利用漁船運輸量大、海上監管困難的特性,穿梭於國境之間。本研究目的係探討國際間毒品走私之現況與趨勢,以及我國利用漁船進行毒品走私的犯罪手法及環境因素,並以環境犯罪學作為理論依據。本研究從文獻分析國際海上毒品販運執法狀況及趨勢,試圖了解國際現況;另外蒐集我國2017年1月1日至2021年12月31日止各地方法院第一審判決有罪之毒品跨境運輸案件判決書,彙整出785件作為研究母體,再從當中篩選出31件利用漁船進行毒品走私之案件作為研究樣本,以次數分配及交叉比對進行

官方文件內容分析。從我國利用漁船走私毒品犯罪歷程分析顯示,毒品主要來源國為中國大陸,但仍有近四成的案件來源國不明,足見這類型的案件向上溯源不易;毒品交易地點大多聚集在臺灣海峽,與來源國主要為中國大陸有正相關;運輸手法主要係於海上以子母船轉運之分段接駁,並以多種運輸手法層轉接駁毒品上岸;藏匿毒品手法主要為暗(密)艙藏匿、置於船艙;進港時段集中於18時至24時,入境縣市則以屏東縣為最多。本研究從日常生活理論、犯罪型態理論及理性選擇理論分析、解讀利用漁船走私毒品的犯罪成因,並從情境犯罪預防理論提出相對應的防制策略。研究建議應持續關注國際毒品犯罪趨勢、法規制(訂)定與時俱進的檢討、增設與運用科技設備以

提升監控量能、藉由環境營造移除適合犯罪的環境機會、輔導漁業轉型以降低犯罪動機,以及促成跨部門及國際緝毒執法合作,在犯罪發生之前阻止潛在犯罪者著手進行利用漁船跨境運輸毒品的犯罪發生。
