研發固定化精油之活性包材延長烘焙產品儲藏期限

烘焙產品是食品產業中的重要的品項，但易受真菌生長造成經濟損失，甚至危害健康。精油具抗菌活性，近年來常用為保存劑。但直接添加精油可能對烘焙產品造成不良感官特性。故本研究以精油混合玉米醇溶蛋白，藉固定化於UV/O3/TiO2改質的低密度聚乙烯膜表面，製備活性抗菌包材，並探討對烘焙產品中Aspergillus niger之抑制，及氣味感官的影響。LDPE經UV/O3/TiO2改質六小時，FT-IR測得1716cm-1處穿透率下降，表示-C=O團基在表面生成，達到改質效果。另玉米醇溶蛋白中-N-H基的鑑出，顯示玉米醇溶蛋白與改質膜鍵結。含增塑劑PG之抗菌膜，FT-IR圖譜呈現精油成分之官能基穿透率比

PEG組別還低，顯示PG組別之精油含量比PEG組別還多。透明度以含PG之抗菌膜皆具良好的透視度，推論PEG因分布不均所致。抗菌膜機械強度，以添加PG組的抗張強度皆顯著高於其他組樣本，但含增塑劑PEG之包材則有較佳延展性。楊氏係數以含PG樣本皆比PEG組高，表示該包材較堅硬。抑菌試驗中，活性包材含10%肉桂/PG組具顯著最少的菌落 (3.33±1.53 CFU/plate)。抗菌膜應用在蜂蜜蛋糕時，含肉桂精油組抑制Aspergillus niger效果比檸檬草精油佳。精油含量10%搭配PG增塑劑，肉桂精油組別在第四天出現2.67±1.15 CFU/g，而檸檬草精油為7.33±1.52CFU/g，

顯示精油固定於LDPE膜應用於烘焙產品具降低Aspergillus niger的功效。蜂蜜味、奶香味及整體喜好的品評結果，檸檬草精油搭配PG顯著高於其他三組配方抗菌膜。綜上所述，精油可成功固定在改質後LDPE膜，並達到抑制烘焙產品的黴菌生長之效果，及未來具有市場價值。

地理名稱是日常生活中常見的商業表徵，不少商品的外觀包裝、店家的招牌及廣告文宣都有地理名稱在其中。具有經營品牌意識的業者，甚至將地理名稱設計成商標並申請註冊。關於地理名稱之註冊規範，原則上，單純以商品產地作為商標，以及使用和商品產地或服務來源無關之地理名稱，若有使消費者誤認誤信商品產地之虞，不予註冊。商標法看似已對地理名稱之可註冊性作出規範，但現行商業活動其實比立法者設想的情況複雜許多，有許多商標的表現型態，並不在商標識別性審查基準所列舉地理名稱的類型中。就判斷客體而論，何種商標的表現型態才算是地理名稱？就判斷主體而論，由於業者的行銷手法及資訊的可及性，影響消費者對於商標內容的認知。而消費者有

不同的分群，法院該以何種消費者作為判定的基準？這些問題對地理名稱作為商標的可註冊性影響深遠，卻只有識別性比較常被討論到。本文首先就地理名稱進行定義，接著介紹商標制度中其他與地理名稱有關之概念並進行比較。再從國際公約、美國及我國規範與實務，整理出相關的審查基準，並檢討這些標準的合理性。另外，透過訴訟案件統計，釐清商標包含地理名稱可受到保護之具體程度。最後本文主張，地理名稱能否獲得註冊保護，應以社會整體利益為考量，隨著消費者行為及消費者認知的改變，在保護消費者的同時，應思考如何兼顧申請人的利益，才有助於工商企業正常發展。
