本研究旨在以修正後之整合型科技接受模式(UTAUT)作為本研究之架構發展基礎,探討澎湖地區共享電動機車市場的「績效預期」、「努力預期」、「社會影響」、「促進條件」及「環境意識」對消費者「使用意圖」及「態度」之影響,首先,深入進行了共享經濟、共享機車、整合型科技接受模型(UTAUT)及環境意識等相關文獻探討,並根據研究動機、研究目的及文獻探討,建立研究架構及研究假設。其次,彙整並修訂績效預期、努力預期、社會影響、促成條件、環境意識、態度及使用意圖等研究變項之量表,以做為變項衡量之工具。問卷編製完成之後,以澎湖地區共享電動機車之潛在使用者為研究母體,並以便利抽樣調查方式,進行網路問卷施測。問卷資

禁制令的核發與否,將對標準必要專利權人、標準實施者、產業與市場競爭帶來不小影響,各國更因而無不謹慎對待。從而本文將綜合美國、歐洲與亞洲之立法、行政與司法層面,進行詳盡比較法分析,探討各國如何在權利保護與公共利益間達成平衡,以及影響各國見解發展之因素,進而再深究當事人應如何因應各國不同見解。在即將邁入5G時代之際,各國見解更有開始改變之趨勢,美國DOJ、USPTO與NIST在2019年發布聯合聲明後,從原先採取不輕易核發禁制令之態度,開始轉為支持標準必要專利權人尋求禁制令救濟,放寬其態度,然而標準必要專利權人仍須負起舉證責任,證明應核發禁制令。而從歐洲見解可見,在Huawei v. ZTE案後

多傾向對標準實施者採取不利態度,並且在專利案件一向較多的德國,除標準實施者須先證明標準必要專利權人違反FRAND承諾,防止受到禁制令限制,目前在2020年一系列車聯網訴訟中對標準實施者更是嚴格,特別是全球著名車廠多集中於德國,可見影響層面之大。在亞洲國家,其舉證責任要求則與德國相同,須由標準實施者先行提出,且其見解雖不如歐美詳盡,但因亞洲國家見解有受到歐洲見解影響之趨勢,或可從歐洲見解發展預測未來亞洲見解之發展。從而企業為避免因禁制令受到過大不利益,應依據各國現行執法立場與其於供應鏈所處地位作出改變。並隨著物聯網時代的到來,所涉產業領域增加,亦將連帶擴張標準實施者範圍,更應注意未來見解發展,例

如美國法院與機關在2019年機關聯合聲明後之未來見解發展、歐洲車聯網侵權訴訟引發之各種議題,以及德國與日本傾向修法要求核發禁制令前先進行利益衡量等,均相當值得後續持續觀察。
