創傷性腦損傷後在其身心健康層面有負面影響,綜整過去雖有相關性研究,而文獻有各自探討其中心理韌性、睡眠品質、憂鬱與生活品質之關係,但同時探討心理韌性、憂鬱、生活品質及睡眠品質以上變項之相關性研究則較少,且未有理論驗證,因而引發探討之動機。本研究目的為探討創傷性腦損傷病人之心理韌性、憂鬱、睡眠品質與生活品質之間的關聯性,並以廣建理論建構模式。採橫斷性、描述相關性研究設計,於北部某醫學中心神經外科門診便利性取樣,以結構式問卷調查,主要問卷包括:基本人口學資料、成人心理韌性量表中文版、匹茲堡睡眠品質量表中文版、貝克憂鬱量表第二版中文版及臺灣簡明版世界衛生組織生活品質量表等。利用AMOS第26版統計軟

船舶本質上為動產,但因造價高昂、體積龐大、須經登記,因而具有不動產性格。在商業使用中係作為運送工具,常於世界各港口間移動,當面臨債權人聲請強制執行時,船舶之使用受到限制,影響船舶所有人、相關權利人及旅客、貨物所有人利害甚鉅。基此,國際海事會議、國際海事組織、聯合國國際貿易法委員會及聯合國國際貿易暨發展委員會,權衡各方利益積極制定國際海事公約,維護海上秩序。各國亦因應國情需求訂定船舶執行特別法規,以作為船舶執行之依據。我國強制執行法雖定有船舶執行章節,但多數準用不動產執行程序,產生諸多與船舶特性不相符合之情形。在查封階段,須耗費過多時間確認船舶所有人及使用人,影響執行時效,且無再次扣押制度之設

計。於拍賣階段,除現行船舶鑑價方式不合適、無法展示船舶及拍賣公告期間過短外,更無防堵惡意競買之機制,與欠缺國外應買者友善獲悉拍賣訊息之管道。復因船舶權利人權利之行使與失權效果規定有所不足,致生船舶權利於拍定後是否消滅之疑義。不僅如此,因海商法與強制執行法,於不同時間、參考不同國際公約進行修正,導致海事優先權之行使與船舶假扣押相互矛盾、牴觸之情形。基此,船舶執行法制有檢討之必要。是本文參考歷次船舶扣押公約、海事優先權及抵押權公約之規定,與英、美等航運國家之法制與司法實務見解,及集海事訴訟、船舶執行大成之中國海事訴訟特別程序法相關規定,提出我國宜兼採對物訴訟制度以克服執行困境、建構再次扣押船舶制度

、船舶拍賣程序應以船舶特性為制定考量、執行方法應與時俱進等建議,期可供日後法律修正暨實務運作之參考。另正在討論之北京草案,係處理船舶司法出售後,國際間是否承認其效力之問題,雖屬草案階段,但仍值得關注,我國應對之亦應有提前佈局之規劃。
