船舶本質上為動產，但因造價高昂、體積龐大、須經登記，因而具有不動產性格。在商業使用中係作為運送工具，常於世界各港口間移動，當面臨債權人聲請強制執行時，船舶之使用受到限制，影響船舶所有人、相關權利人及旅客、貨物所有人利害甚鉅。基此，國際海事會議、國際海事組織、聯合國國際貿易法委員會及聯合國國際貿易暨發展委員會，權衡各方利益積極制定國際海事公約，維護海上秩序。各國亦因應國情需求訂定船舶執行特別法規，以作為船舶執行之依據。我國強制執行法雖定有船舶執行章節，但多數準用不動產執行程序，產生諸多與船舶特性不相符合之情形。在查封階段，須耗費過多時間確認船舶所有人及使用人，影響執行時效，且無再次扣押制度之設
計。於拍賣階段，除現行船舶鑑價方式不合適、無法展示船舶及拍賣公告期間過短外，更無防堵惡意競買之機制，與欠缺國外應買者友善獲悉拍賣訊息之管道。復因船舶權利人權利之行使與失權效果規定有所不足，致生船舶權利於拍定後是否消滅之疑義。不僅如此，因海商法與強制執行法，於不同時間、參考不同國際公約進行修正，導致海事優先權之行使與船舶假扣押相互矛盾、牴觸之情形。基此，船舶執行法制有檢討之必要。是本文參考歷次船舶扣押公約、海事優先權及抵押權公約之規定，與英、美等航運國家之法制與司法實務見解，及集海事訴訟、船舶執行大成之中國海事訴訟特別程序法相關規定，提出我國宜兼採對物訴訟制度以克服執行困境、建構再次扣押船舶制度
、船舶拍賣程序應以船舶特性為制定考量、執行方法應與時俱進等建議，期可供日後法律修正暨實務運作之參考。另正在討論之北京草案，係處理船舶司法出售後，國際間是否承認其效力之問題，雖屬草案階段，但仍值得關注，我國應對之亦應有提前佈局之規劃。
