和防止權利濫用重要手段，隨著2001年11月「多哈談判」(Doha Round of World Trade Talks，or Doha Round negotiations)進展，國際社會已就藥品強制許可相關問題達成共識。探討本文各章節依據強制授權制度，研析《巴黎公約》第4條之4規定「獨占」、《TRIPs協定》未相關規定，造成規範模糊。延至大陸《專利法》第56條規定「獨占」，另大陸《專利法》第48條2款規定「壟斷」；台灣《專利法》規定「限制不公平競爭」。前三者規定獨占、壟斷、限制不公平競爭，政府公權力介入，申請強制授權核准，不受法令拘束，實施供應指定機構，第三人取得給付專利權人「補償金」標準
